Partly A first group is the judicature on those provisions which aim at a preventive protection of the marital union. Here, the judge's involvement seems to be sparse for a long time. There are almost no published decisions on the withdrawal of the power to use the keys and their revocation (Articles 000 and 000), nor on the former authorization to exercise a profession (Article 000), which has been discussed so extensively in the literature; A typical example of how socially important changes, in this case the increase in the number of working women, are often little reflected in the law and in the application of the law (see also the reference by Egger, op. cit., p. 00 f.). The case law is richer on other provisions. But it concerns casesin which the protection of marriage has a harmless character, so to speak. These are property relationships, namely those that mostly only indirectly affect the personal relationship between the spouses, such as the prohibition of foreclosure. In addition, the law is not regularly applied because of a dispute between the spouses, but because of a dispute with third parties or even in non-contentious proceedings (Art. 000).
